  • PLAYPAY TERMS OF SERVICE

    The PlayPay Terms of Service ("PlayPay Terms") constitute a legal agreement between you, whether a current or prospective user, and Play Payments LLC ("the Company," "we," "our," or "us"). These terms dictate your use of PlayPay, a financial platform that encompasses mobile applications, websites, software, cloud-based solutions, and other related products and services (collectively referred to as the "Service"). If you are utilizing the Service on behalf of a business or organization, you confirm that you possess the authority to bind that entity and that it accepts these terms. By using the Service, you agree to adhere to these PlayPay Terms and any related policies, including our Privacy Notice and PlayPay Acceptable Use Policy.

    It is essential to thoroughly read all PlayPay Terms, particularly the sections that limit our liability and address individual arbitration for potential legal disputes.
    PRIVACY NOTICE

    This Privacy Notice explains how Play Payments LLC and our affiliates collect, use, disclose, transfer, store, retain, or process your information when you download PlayPay, create a PlayPay account, or utilize our services online at http://playpay.com. This notice pertains specifically to your use of our Services and applies solely to information gathered in connection with accessing and using our Services.     INFORMATION YOU PROVIDE TO ACCESS OUR SERVICES

    We collect information you provide when applying for or signing up for a PlayPay account, completing our identity or account verification process, logging into your account, communicating with us, participating in surveys, or engaging in contests and promotions offered by us or our partners.         • Identification Information: This includes your name, email address, postal code, phone number, Playtag, signature, and authentication credentials, such as your Internet Protocol ("IP") address.
        • Additional Identification Information for Verified Users: If you opt to share it for larger payments, we collect your full mailing address, date of birth, government-issued identification (including Social Security number, passport, or driver's license), and biometrics such as photographs and facial scans.
        • Financial Information: This consists of bank account and payment card numbers that you add to your PlayPay account, along with your Play Card number, if applicable.
        • Contacts Information: We require details about the intended recipient of any payment you request to facilitate. You can provide this by manually entering a phone number or email address into PlayPay or by giving us access to your phone contacts, as explained in "Information You Provide to Enhance Your Experience."
        • Transaction Information: When you use our Services for payments, we collect data such as the timing and location of transactions, names of the parties involved, descriptions of the transactions, payment or transfer amounts, and details about devices and payment methods used.

    INFORMATION YOU PROVIDE TO IMPROVE YOUR EXPERIENCE
    You have the option to share additional information to improve your experience while using our Services, which includes:
        • Contact Information: You may choose to allow us access to your phone contacts. This can make it easier to find individuals you wish to send money to, invite friends to PlayPay, verify accounts and identities, prevent fraud, reduce the likelihood of sending payments to the wrong person, and provide personalized services. You can modify your settings at any time to stop sharing your contacts, but we will always require a recipient's phone number or email address to process any payments you request.
        • Other Information: We also gather information that you voluntarily share with us. This includes your photograph if you decide to upload one, responses to surveys, participation in contests or marketing initiatives, suggestions for improvements, referrals, and any other activities you engage in on the Services.    

    INFORMATION COLLECTED THROUGH YOUR USE OF OUR SERVICES
    We gather data pertaining to you and the devices you utilize to access our services, including your computer, mobile phone, or tablet. The data we collect encompasses the following categories:
    1. Geolocation Information: This includes the precise location of your device, which may involve your IP address, device language, and the location of your network provider. This information may also include detailed geolocation data. For further details and instructions on how to disable the collection of precise geolocation information from your mobile device, please refer to the provided link.
    2. Device Information: This category encompasses details about your device, such as its hardware model, operating system version, device name, unique device identifier, information regarding your mobile network, and how your device interacts with our services. Should you use an iOS device, we also automatically identify whether you have downloaded the Chrome browser. In such instances, we will request your preferred browser for opening links on our PlayPay platform.
    3. Internet or Other Electronic Network Activity Information: This category includes data on your usage and interaction with our services, such as access times, login and logout information, the type and language of your browser, settings on your device (including country and language), IP address, the domain name of your internet service provider, details about your browser, mobile device, and operating system, specific pages visited on our platform, content viewed, features utilized, the date and time of your service usage, search terms entered, and the website visited before or during your service usage.
    4. Inferences Drawn from Collected Information: We may use any collected information to create profiles about you, which may reflect your preferences, characteristics, and behaviors. These profiles may serve various purposes, including account security and the enhancement of our services to you.
    Sources of Information Collected About You
    We collect (and/or have collected during at least the 12-month period preceding the effective date of this Privacy Notice) information about you from the following categories of sources:
    - Direct Information Collection: This involves the collection of data from you directly, either through submissions you make to us or by allowing us access to your information.

    Credit, Compliance, and Fraud: Information pertaining to you from third parties is collected for various purposes, including credit investigations, credit eligibility assessments, identity or account verification processes, fraud detection procedures, and collection activities. This encompasses, among others, the exchange of account or credit-related information with credit reporting agencies or bureaus, where permissible, and any individual or corporation with whom you have, currently hold, or may have a financial relationship, including but not limited to, past, present, and future employers, financial institutions, and personal reporting agencies.

    - Providing, Enhancing, and Developing Our Services: This includes assessing the availability of our services in your country, processing or recording payment transactions or money transfers, offering you the PlayPay product and features of your choice, displaying your historical transaction information, connecting you with individuals you are already acquainted with, enhancing, maintaining, and improving our services, developing new products and services, delivering the information and support you request through our services, personalizing and facilitating your interaction with our services, content, and applications, measuring, tracking, and analyzing trends and usage related to your engagement with our services or the performance of our services, including promotions or discounts offered by us or our partners, and otherwise providing you with the products and features you select to use.
    COMMUNICATING WITH YOU REGARDING OUR SERVICES
        • We will send you surveys to gather your feedback on our Services.
        • We will provide information we believe may be helpful to you or that you have requested concerning our products and services.

    Protecting Our Services and Ensuring a Trusted Environment
        • We will carry out investigations and adhere to all relevant laws, regulations, and industry standards, while responding to legitimate information requests from the government or lawful legal processes.

    With Other Users of Our Services
    • With other users of our services. For instance, we may share information with individuals involved in transactions when you send or receive payments using our services. This is to confirm that they are receiving funds from you or that you have requested payment from them. We may also provide specific information to other PlayPay customers to help them verify the payment recipient, such as your registration date with PlayPay, your presence in their contacts, and the number of contacts who have transacted with you. Furthermore, we may share details with individuals you choose to communicate with through our services, assisting them in identifying you, such as your name, Playtag, and previous transaction history with them. If you prefer, we may also enable you to share additional information about yourself and your use of our services with other PlayPay customers.
    We may share your information with our affiliates and group companies to enhance the services we provide through PlayPay and our other products. This sharing helps us understand your interactions with our offerings, enabling us to improve our services and tailor them to your preferences.
    We also collaborate with service providers who assist in delivering, maintaining, and enhancing our services. This includes vendors involved in fraud prevention, identity verification, and payment processing, as well as financial institutions and credit bureaus related to your transactions.
    Additionally, we work with advertising partners to manage our campaigns, analyze site performance, and track metrics in connection with our services, including contests and special offers.
    Your information is shared with merchants when you make a payment using PlayPay. For example, when you complete a transaction with a merchant, we provide them with your information to facilitate the purchase. If you use PlayPay US, we may also share details regarding offers, such as cash back rewards linked to your usage.
    In the event of business transfers or corporate changes, we may disclose your information to new owners or operators of our services. This includes circumstances involving mergers, consolidations, or restructuring, as well as the sale of our assets.
    We may also need to disclose information to comply with legal requirements or protect our rights and those of our customers. This can involve responding to legal processes, enforcing our agreements, or investigating suspected illegal activities.
    With your consent, we may share your information as directed by you or when you authorize third-party applications to access it.

    If you wish to deactivate your account, you can do so at any time by logging into your PlayPay account and visiting https://playpay.com/support. For a permanent account closure, please reach out to us at https://playpay.com/support.
    To offer specific Services, we may need access to location information, including precise geolocation data from your device. If you do not agree to this, some Services may not work as intended. You can stop the collection of location data at any time by adjusting the settings on your mobile device. However, this may affect the functionality of certain mobile applications. Alternatively, you can cease location data collection by uninstalling Cash mobile applications from your device using the standard process.

    DO NOT TRACK
    Some web browsers let you send Do Not Track (DNT) signals to the websites you visit, indicating that you prefer not to have your online activities monitored. Currently, our websites are not equipped to respond to DNT signals or similar features from browsers.

    Promotional Communications
    You can opt out of receiving promotional push notifications within our app by following the instructions provided on the screen or within those messages. Even if you choose to opt out, we may still send you non-promotional notifications in-app, via email, or through text messages. These might include transaction receipts and information related to your account or the processing of your data as part of our Services.

    HOW WE SECURE INFORMATION
    We implement reasonable measures, including administrative, technical, and physical safeguards, to protect your information against loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. However, the internet cannot guarantee complete security, and we cannot assure the absolute safety of your information during transmission or storage.     STORAGE AND PROCESSING
